These terms of use (the "Terms of Use") govern your use of the ZEEKR RMI System (the "RMI System"). The RMI System is provided by ZEEKR EU B.V., corporate registration number 88529789 and VAT number NL864670795B01, with address Jachthavenweg 112, 1081 KJ Amsterdam, the Netherlands ("ZEEKR", "we", "our" and "us"). The Terms of Use apply between ZEEKR and you, the user of the RMI System ("User", "You" or "Your").
Subject to a valid registration and up to date payment for the use of the RMI System by the company or business where You are active, You may use the RMI System subject to these Terms of Use. We ask You to read the Terms of Use carefully before You start using the RMI System. If You do not accept the Terms of Use, please refrain from using the RMI System.
We may, from time to time, change these Terms of Use without Your prior consent. Changes shall be come into full force and effect immediately after publication thereof by ZEEKR.
2.1
In order to access the RMI System, You will have to create a user account (the "User Account") and sign in to it.
2.2
If You choose to create a User Account, the e-mail and password which You choose as login credentials must not be harmful, abusive, racially or ethnically offensive, sexually explicit, defamatory, infringing any intellectual property right or invasive of personal privacy rights.
2.3
Your account is personal and You are not allowed to transfer Your account to any third party or to allow a third party to use the RMI System through Your User Account. You are responsible for protecting Your login information from access by unauthorized persons. If You have reason to believe that any third party has gained access to Your User Account, You must immediately inform us. We have the right, but not the obligation, to suspend access to Your User Account if we have reason to believe that any third party has gained unlawful access to Your User Account.
2.4
When creating Your User Account, You will be asked to submit certain information about Yourself. Please read the ZEEKR RMI Privacy Policy before You start using the RMI System.
2.5
The use and/or creation of an account required for the RMI System under a false identity, or otherwise by means of incorrect information, are prohibited and may also be a criminal offence.
3.1
You may only use the RMI System and its content subject to and as permitted by a valid limited license separately granted by ZEEKR to the company or business where You are active.
3.2
When You use the RMI System, You must not:
3.2.1
act in breach of these Terms of Use or in violation of applicable law;
3.2.2
upload content that is harmful or infringes the rights of third parties;
3.2.3
obtain unauthorized access to servers or databases used for the operation of the RMI System;
3.2.4
damage, disable, or in any other way impair the RMI System or in relation to the RMI System introduce viruses, "worms", malware, spyware, "trojan horses" or other malicious code or programs that may damage the operation of the RMI System; or
3.2.5
conduct so-called "screen scraping" of the content on the RMI System.
3.3
In case of any (alleged) breach by You of these Terms of Use, ZEEKR may suspend or terminate Your access to the RMI System and the User Account with immediate effect.
4.1
ZEEKR and its licensors own all intellectual property rights to the RMI System and its content, including but not limited to documents, files, text, images, graphics and products found on the RMI System. Nothing in these Terms of Use constitutes a transfer of ownership to You regarding the intellectual property rights of the RMI System and/or its content. 'Intellectual property rights' means any present or future inventions, patents, trademarks, copyright, moral rights, design rights, database rights, know-how, techniques, trade or business or company name, software, code, or other intellectual or industrial property in any materials, works, concepts or ideas, whether tangible or intangible, registrable or not registrable, registered or not registered.
4.2
You may not sell, distribute, publish, broadcast, circulate, exploit, reproduce (in whole or part), transmit (by electronic means or otherwise), modify, display, redeliver, license, or otherwise use the RMI System and/or its content for any public or commercial purpose without our prior permission.
4.3
The RMI System and its content are protected by copyright laws. Reverse engineering of the RMI System and its content is, except as permitted by law, prohibited.
4.4
Unless otherwise indicated, marks, corporate logos, domain names and emblems are subject to trademark rights of ZEEKR or our licensors´ and, as the case might be, third parties´ trademark rights.
5.1
The RMI System and its content are provided "as is" and ZEEKR makes no warranties, either express or implied, regarding the RMI System or its content.
5.2
To the extent permitted by law, we disclaim all liability for damage and loss relating to Your use of the RMI System and its content, including but not limited to the inability to use the RMI System and its content.
5.3
ZEEKR may link to external websites on the RMI System. We are not responsible for these websites or their content.
6.1

7.1
These Terms of Use, each as amended and modified from time to time, together constitute the entire agreement between You and us with respect to the use of the RMI System.
7.2
Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
7.3
If any part of these Terms of Use is held invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible so as to maintain the intent of these Terms of Use, and the other parts will remain in full force and effect.
7.4
Neither party may assign its rights or obligations under these Terms of Use to any third party without the other party's written consent. We may, however, assign its rights and obligations under these Terms to any of our group companies.
8.1
These Terms of Use are governed by Dutch law, excluding its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
8.2
Disputes regarding these Terms of Use will exclusively be resolved in by the competent court of Amsterdam, the Netherlands.

This policy describes how ZEEKR EU B./V. (also referred to as "ZEEKR", "we" or "us") will make use of your data when you register for and interact with our Repair and Maintenance Information system ("RMI system").
It also describes your data protection rights, including the right to object to some of the processing which ZEEKR carries out. More information about your rights, and how to exercise them, is set out in the "Your choices and rights" section.
Where we refer to personal data below, we mean any information relating to an identified or identifiable living person.

We protect your personal data from loss, misuse, disclosure, alteration, unavailability, unauthorised access and destruction and maintain the confidentiality of your personal data. This is also ensured using appropriate technical and organisational measures. We choose our security measures taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons and continuously improve them.
We only maintain the personal data we collect for as long as it is necessary for us to provide our services, for as long as it is required to fulfil the purposes of the processing of personal data, or as required by law.
Where we process personal data with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests).
We reserve the right to update this Privacy Policy at any time, and we will provide you with a new Privacy Policy when we make any substantial updates. We may also notify you in other ways from time to time about the processing of your personal information.
